Letting the Supreme Court die.

Quote
As a matter of constitutional law, the Senate is fully within its powers to let the Supreme Court die out, literally. I’m not sure such a position is politically tenable—barring some extraordinary circumstance like overwhelming public opinion against the legitimacy of the sitting president—but it’s definitely constitutional....

So when you get past the gotcha headlines, breathless reportage, and Inauguration Day, if Hillary Clinton is president it would be completely decent, honorable, and in keeping with the Senate’s constitutional duty to vote against essentially every judicial nominee she names.

This is an acceptable outcome to me. My chief beef with this election is that the entire government is illegitimate and corrupt. Not because of the fact that Clinton committed crimes, but the fact that the DOJ was so clearly complicit in covering it up. Simply put, voting is consent, and I don't want to give my consent (although I may not refuse).

So if the GOP wants to maintain the excruciating letter of the law, and refuse to make appointments, that would be an acceptable way of invalidating the results of the election.

Odds of it happening are 0.000%.

It would be constitutional if they voted down anybody that the president nominates, even if it's every nominee.  If they just never voted that would look bad politically and, at least in my layman's view, be wrong.

This makes for a fun little fantasy, but it will never happen.  While we have all been agonizing over the presidential election, we have missed the fact that the Senate is likely to slide back into Democrat control this go around.  Say hello to Harry Reid as Majority Leader.

I find myself wishing for the SMOD to strike DC when every swing Richard is in town so we can start over with a clean slate at this point.

Won't it be Schumer?  I though Reid was retiring/not running.

Been watching the show Designated Survivor and it is an interesting concept.
There are five things, above all else, that make life worth living: a good relationship with God, a good woman, good health, good friends, and a good cigar.

Only two defining forces have ever offered to die for you, Jesus Christ and the American Soldier.  One died for your soul, the other for your freedom.

Gave me some pleasant dreams.
If ye love wealth better than liberty, the tranquility of servitude better than the animating contest of freedom, go home from us in peace. We ask not your counsels or your arms. Crouch down and lick the hands which feed you. May your chains set lightly upon you, and may posterity forget that you were our countrymen.

Article II, Section 2 of the U.S. Constitution

The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.

The POTUS can fill judicial vacancies when Congress is not in session. Theoretically there is nothing stopping the POTUS from putting the same person in the same vacancy on a yearly basis.

And I'm fearing the next AWB to be introduced, at a minimum.  At least until SCOTUS has been packed and they can get someone to vote that 2A gives states the right to have a National Guard, and conveys no individual right to own a firearm.

I think that only lasts until the Senate actually votes down the appointment ( at least that is what I thought).
