Supreme Court term limits?

IMHO, this idea is the epitome of hypocrisy. The Congress should enact term limits on representatives and senators before even considering trying to impose term limits on Supreme Court justices.

100% agree with that. I haven't studied the pros and cons of SCJ term limits, but don't think I'd be opposed. SCJs are one group where I think longer term limits would be better than shorter limits.

I'd like to see the gung ho younger Rs stick a "poison pill" in the bill that adds term limits for House and Senate. And those can be shorter.

I do believe Glenn Reynolds floated the idea of the state legislatures picking one or two Supreme Court Justices each.

I though it sounded like a good idea... though really, eliminating the popular vote for Senators would have a similar effect.

It can't be done via legislation.  An amendment to the U. S. Constitution would need to be passed in the appropriate manner.

Seems like they're trying to weasel around that. I don't think it works.

The bill seeks to avoid constitutional concerns by exempting current justices from the 18-year rule. Those appointed under term limits would become “senior” upon retirement and rotate to lower courts.

The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish. The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behaviour, and shall, at stated Times, receive for their Services, a Compensation, which shall not be diminished during their Continuance in Office.

Veerrrrry dangerous in a politically charged environment.  Especially if demorats are in power.

Much as I have misgivings about messing with the Constitution by adding term limits, I think they make a lot of sense for the SCOTUS. People live forever these days.
