SCOTUS trivia question
« on: June 03, 2009, 09:48:01 AM »
When has SCOTUS ever overruled a prior SCOTUS decision?

I seem to recall this happening like, once, or something like that.

Help?

Thanks.

You mean like Plessy, the income tax cases, the roadblock cases, etc.?

Are you looking for a particular instance?
I do not smoke pot, wear Wookie suits, live in my mom's basement, collect unemployment checks or eat Cheetoes, therefore I am not a Ron Paul voter.

Dred Scott comes to mind...

In history, many times.

That was not true of the Guantanamo related rulings.

Most recent example of a straight overrule I can think of is Lawrence v. Texas, overruling Romer v. Evans (from the 80's).

Hey ET  =D

I guess I was just looking for frequency (in total to date).

I wonder to what extent SCOTUS could even overturn Heller down the road.

Pretty much anytime the majority syas Heller was wrong, like if the Chicago handgun ban hits SCOTUS after the shift of power has taken place.  They need to have a valid case before them on point, and then can pretty much do as they please.

Even more recent was one from less than 2 weeks ago:  http://lawofcriminaldefense.com/blog/index.php?blog=1&title=scotus_overrules_michigan_v_jackson_on_r&more=1&c=1&tb=1&pb=1
