Oregon and Fed Gun Laws
« on: October 09, 2021, 08:28:57 AM »
I read this local story on Oregon groups pushing for more gun control there. Not surprising, and sadly for my OR friends here, quite possibly something that might pass given the Portland metro area.

One thing that threw me in the article:

Quote
Federal rules outline when gun dealers have to notify federal and local agencies. Gun dealers only must notify the ATF and local law enforcers if someone buys two or more handguns within 5 days. It does not cover rifle purchases, nor does it cover individual purchases made at separate dealers.

Am I the only guy who didn't know about this? Is it just bad reporting? Many states (like mine) forego background checks for CCW license holders. If I were to go to my LGS today and buy two pistols, they have to report me to the feds and the Sheriff?

Again, maybe the rest of you knew about this, but it's one of the things that infuriates me about having a bajillion laws on the books. I don't have the time or resources to keep up on everything. It's why I always say that we are all felons.

Yes I think it’s one of the Brady laws that multiple handgun purchases get reported when bought from an FFL whether the CCW or the NICS was the background check

Yeah, that’s been around quite a while.  Likely the reasoning was to catch people buying for resale on the black market.

I thought that was put in as a rule back during the Obama years when Fast and Furious was going on and they were trying to use border violence to justify more gun control.  I think they later expanded the coverage.  It was supposed to curb straw purchases.

My dealer would have to report if I bought two pistols within a week of each other (or calendar week, I forget).  So I could buy 10 pistols from 10 different dealers in a day, but two from the same dealer would get me reported.

So how does the reporting to local LE work? Same as like when you get a can?

Yes. There's a separate form the FFL has to fill out, and it happens whether or not the buyer is aware of it. The buyer doesn't have to sign it, so many people remain unaware of this requirement.
